Child Visa (Offshore) Subclass 101

This visa lets a child outside Australia move to Australia to live with their parents.

Sponsor

  • You must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen. 
  • You must be 18 years old or older. You can sponsor a child for this visa if the child is under 18 years old and you are no longer the partner of the child’s parent, but you have legal responsibility for the child. You can sponsor a child for this visa if you are their adoptive parent and you adopted them before becoming an Australian citizen or eligible New Zealand citizen, or the holder of an Australian permanent visa.
  • There are no costs involved when applying for sponsorship. You must agree that for the first 2 years the child is in Australia on this visa you will assist them, and any dependent children who are granted the visa with them, with accommodation and financial support to meet the child’s reasonable living needs.
  • You can not withdraw as a sponsor after the grant of the visa, but if you do not comply with your sponsorship obligations for 2 years after the grant date, the visa may be cancelled.

1. How Old Can The Child Be?

The the time of the application decision, the child must be either:

  • under 18 years old, or
  • over 18 and under 25 years and studying full time, or
  • over 18 years with a disability that impedes their ability to work full-time.

2. Can I Sponsor Adopted Children?

Yes, an adopted child can be sponsored but must have been adopted before they turned 18 by a parent who was not an Australian citizen, permanent resident or eligible New Zealand citizen at the time of adoption.

However, a child adopted before they turned 18 by a parent who was already an Australian citizen, permanent visa holder or eligible New Zealand citizen at the time of adoption might be eligible for an Adoption visa (subclass 102).

3. Can I Include Other Children In One Application?

If the child has siblings who also want to apply, submit separate applications for each sibling.

The child’s dependent children can be included on their application when they apply or at any time before the decision of the application.

4. What Are My Visa Conditions?

8502 – Not arrive before person specified in visa



You must not enter Australia before the person specified in the visa has entered Australia. This is usually the main visa holder or other relevant person such as your sponsor in the case of a Partner visa.

8515 – Must not marry or enter into a de facto relationship before entry

The Department might cancel your visa if they find out you were engaged, married or in a de facto relationship before we granted you the visa but did not update your details.
